These Terms and Conditions ("Terms") govern your use of Manggo, a language learning mobile application ("App") operated by Individual Entrepreneur "Xponend" based in Kazakhstan (Almaty) ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
App Description
Manggo is a language learning application that connects users for language exchange and practice. The App provides a platform for users to interact with each other through voice chat, messaging, and other features designed to facilitate language learning.
Eligibility
You must be at least 16 years old to use the App. By using the App, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms. If you are under 18 years old, you must have the consent of a parent or legal guardian to use the App.
User Accounts
Registration
To use certain features of the App, you may need to create an account. When creating an account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Account Security
You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this section.
Use of the App
Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to use the App:
- In any way that violates any applicable law or regulation.
- To harass, abuse, or harm another person, or to promote discrimination or hate speech.
- To impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
- To engage in any conduct that restricts or inhibits anyone"s use or enjoyment of the App.
- To attempt to gain unauthorized access to the App, other users" accounts, or computer systems or networks connected to the App.
User Content
You are solely responsible for any content you post, upload, or share through the App ("User Content"). By posting User Content, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised, without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.
You represent and warrant that: (i) you own the User Content or have the right to grant the rights and licenses described in these Terms, and (ii) the User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity.
Payments
Subscription Plans
The App may offer subscription plans that provide access to premium features. The pricing and features of each subscription plan will be displayed in the App. By purchasing a subscription, you agree to pay the fees indicated for the selected plan.
Payment Processing
Payments are processed through third-party payment processors. By making a payment, you agree to the terms and conditions of the payment processor, in addition to these Terms.
Refunds
All purchases are final and non-refundable, except as required by applicable law. If you believe you are entitled to a refund, please contact us at hello@manggo.space.
Termination
We reserve the right to terminate or suspend your account and access to the App at any time, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms. Upon termination, your right to use the App will immediately cease.
Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Limitation of Liability
IN NO EVENT SHALL WE, OUR AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; (III) ANY CONTENT OBTAINED FROM THE APP; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. The updated Terms will be posted on the App, and the date of the latest revision will be indicated at the beginning of the Terms. Your continued use of the App after the changes will signify your acceptance of the updated Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of the Republic of Kazakhstan.
